First Amendment Auditors

Across the United States, local governments are facing a challenging new trend known as "First Amendment audits." In these encounters, independent videographers film inside or outside public buildings, such as town halls, libraries, and police stations, In order to test whether government employees respect the constitutional right to record in public spaces.

Because these interactions often spark confusion and friction, an increasing number of incidents have escalated into costly constitutional lawsuits and financial payouts for towns.

A "successful" audit occurs when government staff treat the videographer normally, ignoring the camera. However, because auditors often behave in an intentionally unusual or disruptive manner, treating them like ordinary citizens can be highly challenging for employees. A "failed" audit involves a confrontation where staff order the auditor to stop filming, threaten arrest, or remove them from the premises. “I believe that videoing others in public areas without their consent should be punishable because it is an invasion of privacy.” NHS Junior Alina Bolf said.

The rise of online videos documenting confrontations between auditors and law enforcement, government staff, or citizens has brought significant attention to the practice. Audits have also become a highly profitable “business” and even a primary source of income for some auditors.

Because these audits are heavily monetized largely through YouTube, Audit creators face intense competition for views. This incentive often drives auditors to use confrontational tactics, deliberately provoking hostile reactions from town officials to maximize engagement and revenue.

Due to these actions Clinton police have issued a warning to citizens and local businesses advising that “The best response is no response.” First Amendment auditing is also not a single, formally organized movement. Individuals differ in their methods, objectives, and understanding of the law so some operate as peaceful citizen journalists seeking transparency, while others act as hostile provocateurs looking to escalate situations for profit. "While recording in public is generally protected by the First Amendment, some individuals may intentionally attempt to provoke confrontations or emotional reactions for videos they later post on social media," Clinton police said in the post.

The First Amendment, in essence, protects important freedoms, including speech, press activity, and certain forms of recording. Those protections are substantial, but they operate alongside lawful restrictions on access, safety, privacy, and interference with official duties. Commander Kevin Baysinger and Sergeant Michael Thomas of the OPD police department in Oxnard, California, emphasized that  "As law enforcement officers, we are obligated to enforce laws and statutes during the course of our duties. We must also realize that our own behavior and actions are governed by the same laws we are sworn to uphold."

Ultimately, neither the label auditor nor the presence of a camera determines whether conduct is lawful. The answer depends on the facts, the location, the applicable rules, and the constitutional standards governing the encounter.

Understanding the issue requires more than choosing sides in a confrontation. It requires examining evidence, applying the law accurately, and recognizing that accountability and constitutional rights depend on facts rather than assumptions.
